Purpose of the Code<\/strong><\/h3>\n<p data-start=\"258\" data-end=\"643\">The purpose of this policy is to define the confidentiality and cooperation obligations for partners, external service providers, trainers, mentors, photographers, stylists and other subcontractors working with Elite2You Digital Model Agency (hereinafter referred to as &#8220;the Agency&#8221;).<br data-start=\"536\" data-end=\"539\">The purpose of this policy is to protect the Agency&#8217;s know-how, trade secrets, models and systems.<\/p>\n<hr data-start=\"645\" data-end=\"648\">\n<h3 data-start=\"650\" data-end=\"676\"><strong data-start=\"654\" data-end=\"676\">2. Scope of application<\/strong><\/h3>\n<p data-start=\"677\" data-end=\"760\"><strong>The scope of the Code covers any person or organisation who:<\/strong><\/p>\n<ul data-start=\"761\" data-end=\"1115\">\n<li data-start=\"761\" data-end=\"879\">\n<p data-start=\"763\" data-end=\"879\">is not an internal employee, but has a contractual relationship with Elite2You (on account or on a case-by-case basis),<\/p>\n<\/li>\n<li data-start=\"880\" data-end=\"1010\">\n<p data-start=\"882\" data-end=\"1010\">performs any tasks on behalf of or in the interest of the Agency (e.g. photography, training, event organisation, recruitment, consultancy),<\/p>\n<\/li>\n<li data-start=\"1011\" data-end=\"1115\">\n<p data-start=\"1013\" data-end=\"1115\">access to confidential information, model data, internal training materials, systems.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"1117\" data-end=\"1120\">\n<h3 data-start=\"1122\" data-end=\"1159\"><strong data-start=\"1126\" data-end=\"1159\">3. Confidentiality<\/strong><\/h3>\n<h4 data-start=\"1161\" data-end=\"1222\">3.1.  <strong data-start=\"1171\" data-end=\"1222\">Confidential information includes in particular:<\/strong><\/h4>\n<ul data-start=\"1223\" data-end=\"1479\">\n<li data-start=\"1223\" data-end=\"1282\">\n<p data-start=\"1225\" data-end=\"1282\">models&#8217; personal data, photos, videos, online accounts,<\/p>\n<\/li>\n<li data-start=\"1283\" data-end=\"1339\">\n<p data-start=\"1285\" data-end=\"1339\">training materials, examination systems, sample certificates,<\/p>\n<\/li>\n<li data-start=\"1340\" data-end=\"1399\">\n<p data-start=\"1342\" data-end=\"1399\">internal business strategies, partner lists, marketing materials,<\/p>\n<\/li>\n<li data-start=\"1400\" data-end=\"1479\">\n<p data-start=\"1402\" data-end=\"1479\">the digital platforms used by the Agency and their operational processes.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"1481\" data-end=\"1511\">3.2.  <strong data-start=\"1491\" data-end=\"1511\">Commitments:<\/strong><\/h4>\n<ul data-start=\"1512\" data-end=\"1780\">\n<li data-start=\"1512\" data-end=\"1600\">\n<p data-start=\"1514\" data-end=\"1600\">The partner must keep all business, technical and personal data confidential,<\/p>\n<\/li>\n<li data-start=\"1601\" data-end=\"1677\">\n<p data-start=\"1603\" data-end=\"1677\">You may use the information received only for the purpose of cooperation,<\/p>\n<\/li>\n<li data-start=\"1678\" data-end=\"1780\">\n<p data-start=\"1680\" data-end=\"1780\">You may not share confidential information with any third party, whether orally, in writing or digitally.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"1782\" data-end=\"1821\">3.3.  <strong data-start=\"1792\" data-end=\"1821\">Duration of confidentiality:<\/strong><\/h4>\n<ul data-start=\"1822\" data-end=\"1926\">\n<li data-start=\"1822\" data-end=\"1926\">\n<p data-start=\"1824\" data-end=\"1926\">Confidentiality is not only for the duration of the active cooperation, but also for at least 5 years afterwards.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"1928\" data-end=\"1931\">\n<h3 data-start=\"1933\" data-end=\"1974\"><strong data-start=\"1937\" data-end=\"1974\">4. Cooperation obligations<\/strong><\/h3>\n<h4 data-start=\"1976\" data-end=\"2026\">4.1.  <strong data-start=\"1986\" data-end=\"2026\">Brand loyalty and willingness to cooperate<\/strong><\/h4>\n<p data-start=\"2027\" data-end=\"2052\"><strong>The partner undertakes to:<\/strong><\/p>\n<ul data-start=\"2053\" data-end=\"2416\">\n<li data-start=\"2053\" data-end=\"2130\">\n<p data-start=\"2055\" data-end=\"2130\">cooperate in good faith and in the interests of the Agency,<\/p>\n<\/li>\n<li data-start=\"2131\" data-end=\"2226\">\n<p data-start=\"2133\" data-end=\"2226\">does not represent a competing business in the same scope of services during the period of cooperation,<\/p>\n<\/li>\n<li data-start=\"2227\" data-end=\"2308\">\n<p data-start=\"2229\" data-end=\"2308\">does not recruit models or clients from the Agency for its own or other purposes,<\/p>\n<\/li>\n<li data-start=\"2309\" data-end=\"2416\">\n<p data-start=\"2311\" data-end=\"2416\">not use Agency material in your own business, education, platform, social media.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"2418\" data-end=\"2461\">4.2.  <strong data-start=\"2428\" data-end=\"2461\">Communication and data security<\/strong><\/h4>\n<ul data-start=\"2462\" data-end=\"2721\">\n<li data-start=\"2462\" data-end=\"2584\">\n<p data-start=\"2464\" data-end=\"2584\">The partner is required to communicate with models and staff in a civilised, ethical and secure manner.<\/p>\n<\/li>\n<li data-start=\"2585\" data-end=\"2721\">\n<p data-start=\"2587\" data-end=\"2721\">In particular, sending data, files and content through private, non-company channels (e.g. Messenger, WhatsApp) is prohibited.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2723\" data-end=\"2726\">\n<h3 data-start=\"2728\" data-end=\"2769\"><strong data-start=\"2732\" data-end=\"2769\">5. Consequences of breach of contract<\/strong><\/h3>\n<ul data-start=\"2770\" data-end=\"3083\">\n<li data-start=\"2770\" data-end=\"2879\">\n<p data-start=\"2772\" data-end=\"2879\">Breaches of confidentiality or of the rules of cooperation constitute a serious breach of contract.<\/p>\n<\/li>\n<li data-start=\"2880\" data-end=\"2976\">\n<p data-start=\"2882\" data-end=\"2976\">A breach of the rules can lead to immediate termination of the contract and liability for damages.<\/p>\n<\/li>\n<li data-start=\"2977\" data-end=\"3083\">\n<p data-start=\"2979\" data-end=\"3083\">The Agency reserves the right to initiate legal proceedings, proceedings before a judicial authority, a data protection authority or a civil action.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3085\" data-end=\"3088\">\n<h3 data-start=\"3090\" data-end=\"3126\"><strong data-start=\"3094\" data-end=\"3126\">6. Prohibition of disclosure<\/strong><\/h3>\n<ul data-start=\"3127\" data-end=\"3303\">\n<li data-start=\"3127\" data-end=\"3224\">\n<p data-start=\"3129\" data-end=\"3224\">The partner may not make any statements, provide press material or launch any campaign on behalf of the Agency.<\/p>\n<\/li>\n<li data-start=\"3225\" data-end=\"3303\">\n<p data-start=\"3227\" data-end=\"3303\">Public display is subject to prior written permission.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3305\" data-end=\"3308\">\n<h3 data-start=\"3310\" data-end=\"3344\"><strong data-start=\"3314\" data-end=\"3344\">7.
