Purpose of the Code<\/strong><\/h3>\n<p data-start=\"296\" data-end=\"609\">The purpose of this policy is to regulate the management of the rights to the likeness of persons in photographs and videos and the copyright of images taken by photographers.<br data-start=\"483\" data-end=\"486\">Our aim is to protect the rights of models and photographers and to ensure the lawful use of images for commercial and promotional purposes.<\/p>\n<hr data-start=\"611\" data-end=\"614\">\n<h3 data-start=\"616\" data-end=\"636\"><strong data-start=\"620\" data-end=\"636\">2. Principles<\/strong><\/h3>\n<ul data-start=\"638\" data-end=\"962\">\n<li data-start=\"638\" data-end=\"765\">\n<p data-start=\"640\" data-end=\"765\">The right to the model\u2019s likeness is a personal right, the use of which requires prior written consent.<\/p>\n<\/li>\n<li data-start=\"766\" data-end=\"962\">\n<p data-start=\"768\" data-end=\"962\">Images taken by the photographer are protected by copyright and written permission is also required for use, unless they were created by Elite2You under a commissioned, transferred right.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"964\" data-end=\"967\">\n<h3 data-start=\"969\" data-end=\"1041\"><strong data-start=\"973\" data-end=\"1041\">3. Model\u2019s consent to use the images (Model Release)<\/strong><\/h3>\n<h4 data-start=\"1043\" data-end=\"1078\">3.1.  <strong data-start=\"1053\" data-end=\"1078\">Mandatory contribution<\/strong><\/h4>\n<p data-start=\"1079\" data-end=\"1137\"><strong>All models must agree to and sign the following:<\/strong><\/p>\n<ul data-start=\"1138\" data-end=\"1476\">\n<li data-start=\"1138\" data-end=\"1281\">\n<p data-start=\"1140\" data-end=\"1281\">You consent to Elite2You using your images and videos for marketing, education, sales or other commercial purposes.<\/p>\n<\/li>\n<li data-start=\"1282\" data-end=\"1476\">\n<p data-start=\"1284\" data-end=\"1476\">You agree that the content may be displayed on Elite2You websites (e.g. elite2you.com, elite2fans.com, models2you.com) and external platforms (Instagram, TikTok, Google Ads, posters, etc.).<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"1478\" data-end=\"1508\">3.2.  <strong data-start=\"1488\" data-end=\"1508\">Right of withdrawal<\/strong><\/h4>\n<p data-start=\"1509\" data-end=\"1568\"><strong>The model may request the removal of certain content if:<\/strong><\/p>\n<ul data-start=\"1569\" data-end=\"1763\">\n<li data-start=\"1569\" data-end=\"1625\">\n<p data-start=\"1571\" data-end=\"1625\">are contrary to ethical or legal codes,<\/p>\n<\/li>\n<li data-start=\"1626\" data-end=\"1763\">\n<p data-start=\"1628\" data-end=\"1763\">the display compromises your personal safety or reputation.<br data-start=\"1696\" data-end=\"1699\">The removal request will be processed by Elite2You within 30 days.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"1765\" data-end=\"1805\">3.3.  <strong data-start=\"1775\" data-end=\"1805\">Restrictions on content use<\/strong><\/h4>\n<p data-start=\"1806\" data-end=\"1914\">Images of the model may not be transferred to other third parties for commercial use without the knowledge and consent of the model.<\/p>\n<hr data-start=\"1916\" data-end=\"1919\">\n<h3 data-start=\"1921\" data-end=\"1998\"><strong data-start=\"1925\" data-end=\"1998\">4. Photographer Release and Copyright Permission (Photographer Release)<\/strong><\/h3>\n<h4 data-start=\"2000\" data-end=\"2056\">4.1.  <strong data-start=\"2010\" data-end=\"2056\">Transfer of rights in the case of an agency order<\/strong><\/h4>\n<p data-start=\"2057\" data-end=\"2132\">By accepting the assignment, the photographer commissioned by Elite2You undertakes to:<\/p>\n<ul data-start=\"2133\" data-end=\"2394\">\n<li data-start=\"2133\" data-end=\"2290\">\n<p data-start=\"2135\" data-end=\"2290\">assigns to the Agency the right to use all or part of the images produced, including for promotional, advertising and educational purposes,<\/p>\n<\/li>\n<li data-start=\"2291\" data-end=\"2394\">\n<p data-start=\"2293\" data-end=\"2394\">no extra royalties or recurring fees are paid for the images if the photography has already been paid for at a fixed rate.<\/p>\n<\/li>\n<\/ul>\n<h4 data-start=\"2396\" data-end=\"2435\">4.2.  <strong data-start=\"2406\" data-end=\"2435\">Photographer\u2019s general licence<\/strong><\/h4>\n<p data-start=\"2436\" data-end=\"2486\"><strong>External photographers are required to declare that:<\/strong><\/p>\n<ul data-start=\"2487\" data-end=\"2806\">\n<li data-start=\"2487\" data-end=\"2564\">\n<p data-start=\"2489\" data-end=\"2564\">the pictures were taken with their own tools and by working independently,<\/p>\n<\/li>\n<li data-start=\"2565\" data-end=\"2650\">\n<p data-start=\"2567\" data-end=\"2650\">have all the necessary technical and legal rights to take the photos,<\/p>\n<\/li>\n<li data-start=\"2651\" data-end=\"2806\">\n<p data-start=\"2653\" data-end=\"2806\">undertake not to sell or publish the images to third parties, unless specifically agreed between the model and Elite2You.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"2808\" data-end=\"2811\">\n<h3 data-start=\"2813\" data-end=\"2846\"><strong data-start=\"2817\" data-end=\"2846\">5. Ownership and storage<\/strong><\/h3>\n<ul data-start=\"2848\" data-end=\"3118\">\n<li data-start=\"2848\" data-end=\"2972\">\n<p data-start=\"2850\" data-end=\"2972\">Digital copies of images and videos are stored on Elite2You\u2019s internal servers or on dedicated cloud storage.<\/p>\n<\/li>\n<li data-start=\"2973\" data-end=\"3118\">\n<p data-start=\"2975\" data-end=\"3118\">Access to the original files is restricted to designated content managers, area directors and the model\u2019s own representative.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3120\" data-end=\"3123\">\n<h3 data-start=\"3125\" data-end=\"3163\"><strong data-start=\"3129\" data-end=\"3163\">6. Litigation and enforcement<\/strong><\/h3>\n<ul data-start=\"3165\" data-end=\"3464\">\n<li data-start=\"3165\" data-end=\"3265\">\n<p data-start=\"3167\" data-end=\"3265\">In the event of a dispute over the content of any dispute, the parties shall seek amicable settlement as a matter of priority.<\/p>\n<\/li>\n<li data-start=\"3266\" data-end=\"3371\">\n<p data-start=\"3268\" data-end=\"3371\">The place of jurisdiction for the resolution of disputes is [the competent jurisdiction in the country], according to the place where Elite2You has its registered office.<\/p>\n<\/li>\n<li data-start=\"3372\" data-end=\"3464\">\n<p data-start=\"3374\" data-end=\"3464\">Photographers and models must cooperate in all disputes and act in good faith.<\/p>\n<\/li>\n<\/ul>\n<hr data-start=\"3466\" data-end=\"3469\">\n<h3 data-start=\"3471\" data-end=\"3505\"><strong data-start=\"3475\" data-end=\"3505\">7.
